Bill Description: House Concurrent Resolution 9 would create the framework for selecting commissioners who will comprise the Idaho delegation at an Article V convention of states, should one be successfully called.
Rating: 0
Does it violate the spirit or the letter of either the United States Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the US Constitution or the Idaho Constitution?
This Convention of States Resolution outlines the definition of commissioners and the advisory committee; the qualifications, selection and removal of commissioners, the oath, credentials, and compensation of commissioners, and sets forth an advisory committee with plenary powers over the commissioners. Whatever your view of the desirability of an Article V convention, this resolution is fairly comprehensive as a listing of duties and limitations document for the commissioners, with one concerning limitation regarding the advisory committee. The advisory committee consists of three members, one of each selected by the Senate Pro Tempore and the Speaker of the House, with the third selected by the same leaders with the consent of the majority of both chambers. This gives two leaders effective control of the advisory committee and those commissioners are subject to no further action by the legislature.
