House Bill 442 — Prohibition, rent regulation

Bill Description: House Bill 442 prevents local governments from regulating deposits required or fees levied for leasing private residential property.

Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in the market?

Idaho law prohibits local governments from controlling the amount of rent charged for leasing private residential property.

House Bill 442 amends Section 55-307, Idaho Code, to expand this prohibition to prohibit local governments from regulating fees and deposits in addition to rent. This change serves to reduce local government intervention in the rental market.
