SB 1388 is a clarification bill that ensures various sections of Idaho Code are aligned with each other. In current code, if someone's license is suspended for having driven under the influence of alcohol or another intoxicating substance, the suspension does not end even when the DUI charge is “vacated or dismissed.” SB 1388 would ensure that all “driving privileges shall be restored” to a person whose DUI charge has been vacated or dismissed.
