Bill Description: This bill would take out a reference to the American Dental Association in the statutes that regulate the practice of dentistry.
Rating: +1
Does it violate the principle of equal protection under the law? Conversely, does it restore or protect the principle of equal protection under the law?
References to private organizations, such as professional associations, rating agencies, and unions, can be found interspersed throughout Idaho Code. When these private entities are indefinitely preserved in statutes it gives them an unfair advantage against current or potential competitors, unfairly equating their private decisions with state law.
This bill would eliminate one such reference from the definition found for Dental Specialists. Currently, only dental specialties recognized by the American Dental Association are recognized in Idaho. Under this change, the Idaho Board of Dentistry could approve any specialty, regardless of what the American Dental Association chooses to do.(+1)
