Bill Description: Senate Bill 1442 “establishes enhanced transparency, accountability, and reporting requirements related to refugee resettlement and immigration status within the State of Idaho.”
Rating: +1
Does it violate the spirit or the letter of either the United States Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the US Constitution or the Idaho .Constitution?
The basis of the constitution is a compact between citizens for the protection of their fundamental rights. Harboring or concealing illegal aliens in order to facilitate these individuals avoiding deportation undermines the sovereignty of the nation. Sovereignty necessarily encompasses the ability to determine who can enter the compact and on what terms. By preventing resettlement agencies from “harboring or concealing an illegal alien…” this legislation would uphold the Sovereignty of Idaho and the United States.
Additionally, the State of Idaho is not obligated to accept federal determinations about the suitability of refugees for resettlement in this state. Requiring data collection and reporting is a small first step toward the state asserting its sovereignty to decline to participate in this unconstitutional federal overreach.
