
Bill Description: Senate Bill 1322 would require a voter who files an affidavit in lieu of showing ID provide either their birthdate or driver's license/identification card number.

NOTE: Senate Bill 1322 deals with the same issue as Senate Bill 1237 (2026), but rather than abolishing the affidavit alternative, Senate Bill 1322 would modify it.

Senate Bill 1322 would amend Section 34-1114, Idaho Code, which allows a voter to complete an affidavit in lieu of showing photo ID at a polling place.
The bill would newly require that a voter completing the affidavit provide “either the voter's date of birth or the voter's Idaho driver's license or identification card number.”
It would further stipulate that “the judges of election shall verify the information against the voter registration records prior to issuing a ballot.”
While this change could complicate and slow the voting process somewhat (an issue alleviated by simply eliminating the affidavit alterative), it would improve election integrity and security.
NOTE: This bill would not take effect until July 1, 2026, so it would not apply to the 2026 Primary Election in May.
