Does it increase barriers to entry into the market? Examples include occupational licensure, the minimum wage, and restrictions on home businesses. Conversely, does it remove barriers to entry into the market?
Section 54-716, Idaho Code, currently gives licensed chiropractors who are certified in clinical nutrition the authority to “obtain” and “independently administer, during chiropractic practice” certain prescription drug products that are listed in code. Most of the items included in the list are common vitamins and minerals.
Senate Bill 1254 would amend this section to clarify that licensed chiropractors who are certified in clinical nutrition may also “prescribe” these items.
The bill’s statement of purpose says that “currently compound pharmacies and pharmaceutical distributors are not providing” qualified chiropractors access to these substances due to the lack of explicit statutory authority for chiropractors to prescribe them.
