House Bill 646 — Fermented beverages, homemade

Bill Description: House Bill 646 would allow individuals to produce mead, cider, or other fermented beverages for their own use, without fear of legal penalties.

Does it directly or indirectly create or increase penalties for victimless crimes or non-restorative penalties for nonviolent crimes? Conversely, does it eliminate or decrease penalties for victimless crimes or non-restorative penalties for non-violent crimes?

Idaho law contains a provision allowing individuals to produce small quantities of wine or beer "for the personal use of himself, family, and guests."

House Bill 646 would amend Section 23-501, Idaho Code, to expand this provision to include "mead, cider, or other fermented beverages."

Producing alcohol is generally criminalized except under provisions specifically allowed by law, which means this change removes penalties for victimless acts.
