House Bill 63 — Vaccinations, forced, mandates

Bill Description: House Bill 63 protects individuals from forced vaccinations, vaccination mandates, and being isolated or quarantined based on one's vaccination status.

Does it violate the spirit or the letter of either the U.S. Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the U.S. Constitution or the Idaho Constitution?

House Bill 63 creates Section 39-4806, Idaho Code, to establish several important protections for individuals when it comes to vaccinations. The bill goes further and provides that no state of emergency or other such situation can be used as a pretext to bypass these protections. 

The bill strictly prohibits the state and subdivisions of the state from mandating or requiring vaccination of any person.

It prohibits the state and subdivisions of the state from issuing orders of isolation and quarantine "based solely or primarily upon the vaccination status of any person."

It prohibits the actual administration of a vaccine to any person without that individual’s consent or, when applicable, the consent of the relevant parent or legal guardian.
