House Bill 128 — Vehicle dealers, protests, hearings

Bill Description: House Bill 128 would micromanage how vehicle manufacturers and vehicle dealers should handle disputes.

Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in the market?

House Bill 128 would amend Section 49-1614, Idaho Code; repeal and replace Section 49-1617, Idaho Code; and create Sections 49-1617A and 49-1617B, Idaho Code. These sections deal with the relationship between vehicle manufacturers and vehicle dealers, and specifically how they handle disputes. Among other things, the new language says, "All disputes between a manufacturer or a distributor and a new vehicle dealer alleging a violation of any provision of this chapter or any other provision of Idaho law are subject to mediation as provided for in this section."

The business relationships and contracts between vehicle manufacturers and vehicle dealers should not be regulated and micromanaged by government.
