House Bill 463 — Court fees

Bill description: HB 463 increases fees imposed by pretrial supervision programs.

Does it directly or indirectly create or increase any taxes, fees, or other assessments? Conversely, does it eliminate or reduce any taxes, fees, or other assessments?

HB 463 provides that "the board of county commissioners may establish a juvenile supervised pretrial release program" and instructs the courts to "assess a monthly juvenile pretrial supervision fee that shall be an amount no more than the maximum monthly juvenile probation supervision fee…" 

HB 463 further states that a court may "order the juvenile to pay additional fees to cover the actual costs of electronic monitoring, alcohol testing, or drug testing if such monitoring or testing is a condition of the juvenile's release."

HB 463 also says, "Any unpaid juvenile pretrial supervision fee shall be considered a debt owed to the court and may be collected in the manner provided by law for the collection of such debts."

HB 463 newly allows for the collection of adult pretrial supervision fees in the case of a withheld judgement.
