Under current law, county recorders can assess different fees for the many services they provide. For example, if a person is filing a mining claim with their county recorder, they would be required to pay a $10 fee. When a land surveyor files the record of a survey they conducted, they must pay a $5 fee. When recording a home mortgage, the filing fee is $45.
HB 146 would set a flat fee of $27 for almost all services county recorders provide. Regardless of whether an individual is filing one page or 50, the $27 fee would apply. The fiscal note estimates that this would lead to a 21 percent increase in the fees paid to recorders.
In most cases, individuals do not have a choice whether to use the services of a recorder or not. If they have to file a mining claim, record a mortgage, or file a survey, they have no choice but to go through the county. In many cases, HB 146 would force them to pay more.
