Bill description: HB 90 would revise the definitions for all-terrain vehicles (ATVs) and utility-type vehicles.
Rating: +2
Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in the market?
Under current law, ATVs must be less than 50 inches wide, less than 61 inches long (measured from axle to axle), have at least three wheels, and have handlebar-operated steering. HB 90 would ease the restriction on manufacturers by allowing ATVs to have a maximum width of 55 inches.
As customers’ demands are changing and many people are looking for bigger and better ATVs, HB 90 would give the manufacturers greater flexibility to meet their demands.

HB 90 would make a similar change for UTVs. Under current law, they must be less than 74 inches wide, weigh less than 2,000 pounds, be less than 110 inches long, and have at least 4 tires. There are also minimum size restrictions for UTVs. Under HB 90, the maximum width would be increased to 80 inches, and the weight restriction would be eliminated.

Analysts Note:
HB 90 would expand upon HB 24 which passed the House earlier this session. HB 24 would eliminate the 2,000-pound weight limit for UTVs.
