Bill Description: This bill amends numerous aspects of the regulation process for dietitians in the Idaho Code.

Analyst’s Note: This bill is a revised version of House Bill 129 from earlier this session. The author has removed two components previously noted in our bill analysis.

Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in the market?

A new section of 54-3502A of the Idaho Code would would add a host of regulations and prohibitions for dieticians. Limiting the scope of what dieticians may do hinders the practice of their profession. (-1)

The bill would give the Dietetic Licensure Board discretion to allow for the biennial renewal of licenses, but this is not guaranteed as written. (+1)

Does it increase barriers to entry into the market? Examples include occupational licensure, the minimum wage, and restrictions on home businesses. Conversely, does it remove barriers to entry into the market?

 

This bill would make it harder for licensed out-of-state dietitians to get licenses in Idaho. Currently, 54-3508, Idaho Code requires dietitians seeking a state license to have a license from another state and be registered with the Commission on Dietetic Registration. The bill would expect that applicants “not have any disciplinary action, whether past, pending, public or confidential.” Any action would preclude them from their license by endorsement, however minor the discipline and regardless of the outcome of the action. The applicant’s alternative is to submit to the same process as a first-time applicant.(-1)
