Bill Description: House Bill 845 would empower the Department of Health and Welfare to discipline hospitals who abuse Medicaid presumptive eligibility.

The Medicaid presumptive eligibility program allows hospitals to provide services to uninsured patients by presuming that they are likely eligible for the program. This bill would establish a three strikes system for hospitals that violate the Medicaid presumptive eligibility program to combat waste, fraud, and abuse. The SOP states that 70% of individuals deemed presumptively eligible were later found to be ineligible. Projected savings are estimated at $400,000 to the general fund and a reduction of $1.4 million in federal spending, for a total of $1.8 million.
