House Bill 800 — Manufactured home, residential area (+1)

Bill Description: House Bill 800 would require local governments to allow smaller manufactured homes and multi-family manufactured homes.

Does it violate the spirit or the letter of either the United States Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the US Constitution or the Idaho Constitution?

House Bill 800 would amend Section 39-4105, Idaho Code, to add language stating that the definition of a manufactured home includes “multidwelling unit manufactured homes that are constructed in accordance with the HUD manufactured home construction and safety standards.”

The bill would also amend Section 67-6509A, Idaho Code, which deals with governmental restrictions on the siting of manufactured homes. It would add a provision stating that “a manufactured home consisting of a single dwelling unit may be sited on lots where single-family dwellings are allowed. A multidwelling unit manufactured home may be sited only in areas where multifamily dwellings are allowed.”

Currently, a governing board may adopt restrictions requiring that a manufactured home be multi-sectional and enclose a space of at least 1,000 square feet. The bill would change this, allowing both single-section and multi-sectional manufactured homes and reducing the minimum size to 400 square feet for a single section or 800 square feet for a multi-sectional manufactured home.

This change would prevent local governments or zoning boards from banning smaller manufactured homes.
