House Bill 647 — Manufactured homes (+1)

Bill Description: House Bill 647 would allow for smaller manufactured homes and multi-family manufactured homes. It would also prevent new HOA covenants that unreasonably restrict the siting of manufactured homes.

NOTE: This bill is part of a slate of bills, including Senate Bills 1277, 1278, 1279, and 1280, as well as House Bill 647, to alleviate housing shortages and expand property owners’ options by limiting the restrictions HOAs and local governments can impose on them.

Does it violate the spirit or the letter of either the United States Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the US Constitution or the Idaho Constitution?

House Bill 647 would amend Section 39-4105, Idaho Code, to add language stating that the definition of a manufactured home includes “multi-family manufactured homes that are constructed in accordance with the HUD manufactured home construction and safety standards.”

House Bill 647 would create Section 55-619, Idaho Code, to prohibit future HOA covenants that prohibit or unreasonably restrict siting of manufactured homes on lots where single-family dwellings are permitted. Existing covenant prohibitions would remain in force.

Placing limits on HOA restrictions can have both pros and cons, depending on how the HOA functions and how responsive (or unresponsive) it may be to the property owners it governs.

House Bill 647 would amend Section 67-6509A, Idaho Code, which deals with governmental restrictions on the siting of manufactured homes. Currently, a governing board may adopt restrictions requiring that a manufactured home be multi-sectional and enclose a space of at least 1,000 square feet. The bill would change this, allowing both single section or multi-sectional manufactured homes and reducing the minimum size to 400 square feet for a single section or 800 square feet for a multi-sectional manufactured home.

This change would prevent local governments or zoning boards from banning smaller manufactured homes.
