House Bill 637 — Gold and silver, legal tender (+1)

Bill Description: House Bill 637 would recognize that foreign-minted gold and silver coin and specie is legal tender. 

Rating: +1

Does it violate the spirit or the letter of either the United States Constitution or the Idaho Constitution? Examples include restrictions on speech, public assembly, the press, privacy, private property, or firearms. Conversely, does it restore or uphold the protections guaranteed in the US Constitution or the Idaho Constitution?

Section 67-9903(1), Idaho Code, currently says, “To the full extent allowed by clause 1, section 10, article I of, and the tenth amendment to, the constitution of the United States, gold and silver coin and specie minted domestically shall be legal tender in the state of Idaho under the laws of this state. The state may also elect to use gold and silver coin and specie in conducting its business.”

House Bill 637 would replace the word “domestically” in this subsection with “foreign or domestic” to recognize that foreign-minted gold and silver coin and specie is also legal tender in Idaho.
