House Bill 581 is a step in the right direction by clarifying the Legislature's oversight role over court rules, particularly in the realm of family law. Legislative review of judicial rules is a critical accountability function, and this bill reinforces that principle.
That said, the bill's practical impact is limited by fairly weak language. Saying the Legislature “may review” court rules and “shall advise” the Supreme Court of conflicts is almost meaningless and may fail to impose any real check on rulemaking authority.
Despite this shortcoming, H581 is a net positive because it affirms legislative authority over seemingly unchecked judicial power in rulemaking. Even limited clarification of oversight responsibilities improves transparency and accountability in government.
