Bill Description: House Bill 239 would clarify that foreign nationals may not vote in most Idaho elections.

House Bill 239 is a short bill that would amend Section 18-2307, Idaho Code, by adding language clarifying that "it is unlawful for any alien to vote in any election held in this state solely or in part for the purpose of electing or nominating any candidate to any elective office."

It would also add that "it shall be an affirmative defense to the provisions of subsection (1) of this section that an alien reasonably believed at the time of voting in violation of this section that such person was a citizen of the United States."

While this is generally positive, it is unclear why the limitation applies only to elections that include candidates. The prohibition should apply to all elections, even those that are limited to bonds, levies, or ballot measures.
