Currently, Section 67-6513 of Idaho Code permits counties and local political subdivisions to regulate how landowners divide their property. This encumbers personal property management and the process of dividing land for inheritances.
HB 643 creates exemptions for landowners – including the government – who are dividing their property to adjust lot lines, distribute an inheritance, split land greater than 80 acres into parcels larger than 20 acres, grant space for public use, or convey land to a neighbor. Furthermore, these exemptions remain in effect despite any emergency declarations or interim ordinances.
Overall, this policy allows landowners to have more control over their own property, independent of county and local regulations directing how they should be divided. This reduces the government’s power to regulate activities in the free market.
