Bill description: HB 452 would clarify the language in state law that prohibits local governments from banning private home rentals.

Does it give government any new, additional, or expanded power to prohibit, restrict, or regulate activities in the free market? Conversely, does it eliminate or reduce government intervention in the market? 


In 2017, the Legislature passed HB 216, the intent being to prohibit counties and cities from banning short-term rentals in their communities (e.g., rentals commonly offered via Airbnb, VRBO, and other vacation rentals). However, since its implementation, ambiguity in the law’s language has allowed local governments to continue prohibiting people from renting their homes, or rooms in their homes, for short periods.

HB 452 would clarify the language in HB 216 to put an end to local government interference with private property rights, and allow home owners the opportunity to rent their homes for short-term opportunities.
